From the President
Following are updates on some issues currently before the ECA Board and the Evergreen Community at large:
I. Lindahl v. Evergreen Community Association & Ferguson Lawsuit
A. The ECA Board has conducted meetings with Evergreen residents to try
and formulate a proposed revision to the Consolidated Covenants with the
purpose that this matter might be resolved without litigation. The meetings
were unsuccessful in developing proposed language that would be acceptable
to supporters of all parties involved.
B. As indicated in my 21 September 2001 letter, the Court ordered "The
parties to participate in mediation…" to try and resolve the lawsuit.
The parties have agreed that mediation will not resolve the lawsuit and
therefore
are not proceeding with mediation.
C. The ECA Board strongly supports binding arbitration to resolve this
lawsuit prior to scheduled trial in January 2002. To date not all parties
have agreed to binding arbitration.
II. Satellite Dishes
The Board has received several complaints about locations of satellite
dishes that are in public view. Following is a reprint from the Covenants
addressing this issue:
Article 6.8 Antenna. "no rooftop antenna or 'satellite dish' will
be permitted unless such device is located within the structure so as not
to be visible from adjacent homes, or if on the exterior of a residence,
camouflaged and/or landscaped in manner acceptable to the Architectural Review Committee in its sole discretion so as not to be objectionable to adjacent Lot Owners."

From the Treasurer
The ECA account balance as of October 8 was $19,085.47. There are still some expenses
expected in the last quarter for maintenance on the front entry and corridor, legal fees, insurance and communications. It is anticipated that this spending will be well within the original budget presented at the Annual Meeting in April of 2001.
The Board is hopeful that the annual fee amount for 2002 will be not have to be increased from the $60.00 that has remained constant for three years. Over 93% of residents have paid their Maintenance Fees for 2001. If you are one of the few who have not yet remitted the fee, you could save the Association the additional expense of sending out reminders by paying now. The Board and your neighbors would appreciate it.
Fall Clean Up Suggestion
Before the snow starts flying, this would be an opportune time to remove
any unwanted junk from yards, especially if it is visible from the street
or neighboring homes. This would be items like old mowers, bicycles, toys,
sinks, garbage containers and household items that might be alongside a
garage or in the back of the property. Paragraph 6.12 of the Declaration
of Covenants reads: "Garbage containers are to be stored out of view"..and
.."All Lot Owners are responsible for ensuring that their property
remains free of all garbage and debris."
A note to all animal owners or animal caretakers: Please remember to keep your property and others' property clean of all
fecal matter. All animal waste should be removed daily. Thank you to those
of you who so diligently clean up after your dogs as you walk or run with
them. Also, the DNR suggests that we do not feed the deer, as nature provides
a good source of nourishment. The DNR stated that what starts out as feeding
a couple of deer soon expands into feeding a large herd, and these deer
then do not seek natural sources of food. Unfortunately, many people quit
feeding later in the winter due to snow depth, time and cost. The end result
is that the deer die because they had not previously scouted an area
of natural browse.
From the Maintenance Committee
Through the spring and summer months, the Maintenance Committee has implemented
the planned improvements along the Radio Drive frontage of Evergreen. A
second phase of plantings by Maywood Evergreen was done in the spring to
complement the large white spruce planted last fall and to extend the landscaping
out from both sides of Pinehurst. Small white spruce and white birch trees,
interspersed with ginalla maple and low growing sumac shrubs, were planted
in random groupings for about 150 yards to the north and south of Pinehurst.
Placed on the slope in front of the privacy fence, their growth will develop
into a natural noise and visual buffer to the increasing traffic on Radio
Drive and enhance the appearance of the Evergreen community.
Another phase of similar plantings is scheduled for next spring and will extend the landscaping to the north and south boundaries of Evergreen. This will include replacements for this year's plantings that did not survive.
Another objective was regular mowing of the Radio Drive frontage, and after
a slow start, a contractor capable of handling the sloped terrain was found.
Affordable lawn care has been mowing every 2 to 3 weeks to provide a more
manicured look and expose the small trees and shrubs planted this spring.
To help eliminate some standing water at the Pinehurst entry, Washington County was cooperative in regrading the drainage ditch. This will help with the mowing effort.
Horticultural Services continues the contracted work for the Pinehurst
entry area. This includes regular mowing, maintenance of the irrigation
system, and annual plantings for the center island. They are now into the
fall cleanup and trimming phase of their activity.
Maintenance Committee work parties this season included maintenance of the center island electrical supply and lighting, removing litter, watering of new plantings, and new mulch for some of the planting beds. As winter approaches, we'll again shut down the spotlights and install the holiday lights on the center island trees and monument.
Crime Alert Theft from Motor Vehicles / Fraud and Forgery
On October 12, 2001, the Woodbury Department of Public Safety put out a
Crime Alert for its neighborhoods. It states:
"From shopping areas to schools, day cares, parks and homes, vehicle break-ins are occurring with great regularity throughout this city and the entire metro area. Workplaces and gas stations are also experiencing this problem. People are having purses and wallets/checkbooks taken from their cars when they go in to pay for gas purchases. These criminals are using credit cards and checkbooks.
"
We can help prevent these crimes from occurring by following these precautions:
- Leave no valuables, purses, wallets, or checkbooks unattended in your vehicle even for a few minutes.
- Limit the number of credit cards you have as open accounts to no more than two, and having only one is highly recommended. Always carefully check every transaction on every statement and report any that are not correct or suspicious immediately.
- Report any suspicious vehicles or persons loitering about parking lots, schools, day cares, businesses, etc., to the police. Provide the best description possible, including license plates.
- Do not allow anyone to take a credit card out of your sight including wait persons. They can easily make extra copies of your account information and use it to commit fraud or sell the information to those who do.

Taming Leaves
Fall comes and with it leaves,
